A landmark ECJ case challenges whether EU fast-track rules for strategic lithium projects adequately protect the environment

Europe's lithium ambitions have hit a courtroom wall. Filed on 5 February 2026, a landmark lawsuit at the European Court of Justice targets the Critical Raw Materials Act for the first time, challenging Brussels' decision to fast-track a Portuguese lithium mine as a "strategic project."
At the centre of the dispute sits Mina do Barroso, a northern Portuguese site considered one of Europe's most significant proposed sources of lithium. ClientEarth and Portuguese residents' group UDCB brought the case, arguing the European Commission granted strategic status without properly assessing documented environmental and safety risks. Concerns include threats to local water sources, biodiversity loss, and a farming community recognised by the United Nations as a globally significant agricultural heritage system.
Savannah Resources, which holds rights to the deposit, says design changes and enhanced monitoring have substantially addressed those risks. Brussels maintains that national authorities carry responsibility for environmental permitting. That division of responsibility is precisely what the court will scrutinise.
Under the CRMA, strategic designation grants accelerated permits, easier financing, and fewer administrative barriers. A ruling for the claimants would force the Commission to conduct far stricter environmental reviews before granting future designations, slowing Europe's push to source 10 percent of its annual strategic raw materials domestically by 2030. A ruling for the Commission would leave the fast-track framework intact, though it could sharpen opposition at national level across the continent.
With a final ruling expected within two years, the Barroso case is shaping up as a test of whether Europe's raw materials law can deliver both speed and credibility. A framework that survives judicial scrutiny will prove more durable and trusted, giving domestic lithium projects a stronger foundation for the long run.
